SUSPENDING THE EFFECT OF CIRCULAR NO. 08/2022/TT-BKHDT ON BIDDING
On 29 July 2022, the Ministry of Planning and Investment issued Circular No. 16/2022/TT-BKHDT suspending the effect of Circular 08/2022/TT-BKHDT (Cir. 08) dated 31 May 2022 of the Minister of the Ministry of Planning and Investment detailing the provision and posting of information on bidding and contractor selection on the National Bidding Network System and Circular No. 10/2022/TT-BKHDT (Cir. 10) dated 15 June 2022 of the Minister of Planning and Investment detailing the provision and posting of information and contractor selection on the National Bidding Network System. Specifically:
* Cir. 08:
- Suspending the effect of provisions on the roadmap for application of online bidding on packages of procurement of goods divided into several parts specified in Clause 1, Article 37 from 01 August 2022 to 01 January 2023.
- The remaining provisions: suspending the effect from 01 August 2022 to 15 September 2022.
** Cir. 10: suspending the effect from 01 August 2022 to 15 September 2022.
During the time when Cir. 08 and Cir.10 are suspended, some of the previous legal documents will continue to be implemented:
- Circular No. 01/2015/TT-BKHDT dated 14 February 2015;
- Circular No. 03/2015/TT-BKHDT dated 06 May 2015;
- Circular No. 05/2015/TT-BKHDT dated 16 June 2015;
- Circular No. 14/2016/TT-BKHDT dated 29 September 2016; etc.
For packages of procurement of goods:
a) For bidding packages having the issued bidding documents before 01 January 2023, the contractor selection shall be carried out according to the issued bidding documents and effective relevant regulations of law at that time;
b) From 01 January 2023, if the approved bidding package does not apply online contractor selection and have not yet issued bidding documents, it still organizes online contractor selection on the basis of ensuring the roadmap prescribed in Article 37 of Circular No. 08/2022/TT-BKHDT. In this case, the competent person does not have to adjustment the contractor selection plan.
